Using Wake

Terms of Use

These Terms are between you and The Wake Labs LLC ("we", "us", or "our"), the provider of Wake.

These Terms govern your use of the Wake mobile application, website, account, and related services. By using Wake, you agree to them. If you do not agree, do not use Wake.

How Wake protects your alarm

When Wake shows that an enabled alarm is scheduled, the alarm is scheduled on your iPhone through Apple’s AlarmKit. Wake’s server monitoring may recommend an updated time when verified traffic or weather conditions change; the app applies and acknowledges an accepted update while the existing local alarm remains the delivery authority. Wake shows the current scheduling and monitoring state so you can verify it before bed.

Wake’s dynamic recommendations depend on information such as calendar events, predicted travel, weather, location, network availability, and Apple services. That information can be delayed, incomplete, unavailable, or inaccurate. Wake therefore cannot promise a particular wake, departure, travel, or arrival outcome.

Keep your iPhone powered and operating normally, allow the permissions Wake identifies as required, and confirm that Wake shows your alarm as scheduled. Wake is in beta while AlarmKit delivery and Apple Watch overnight behavior are validated across supported physical devices. Do not use Wake as the only safeguard for an emergency, medical need, transportation-safety obligation, life-safety situation, or another circumstance in which a missed alarm could cause injury or immediate danger. Wake is not an emergency, medical, transportation-safety, or life-safety service.

Eligibility and accounts

You must be legally able to agree to these Terms. An account is optional for local Wake features. If you create an account, provide accurate information, protect access to your Apple account and device, and notify us of suspected unauthorized use. You may delete your Wake account from the app.

Permissions and third-party services

Some features depend on iOS permissions and Apple services, including AlarmKit, Calendar, location, notifications, Live Activities, Sign in with Apple, StoreKit, MapKit, and WeatherKit. Their availability and output are outside Wake’s control and may be governed by separate Apple terms. Disabling a permission may disable or limit the related Wake feature.

Acceptable use

You may not misuse Wake, interfere with its operation, probe or circumvent its security, access another person’s account or data, submit unlawful or harmful content, automate abusive requests, reverse engineer the service except where law expressly permits, or use Wake in violation of law or another person’s rights.

Subscriptions and purchases

Wake requires an active monthly or annual subscription to use its premium app features. The exact price, billing period, and any introductory offer available to you are shown on the purchase screen before you subscribe. An annual subscription may include a fourteen-day free trial for eligible new subscribers; the monthly subscription does not include a trial.

Payment is charged to your Apple Account when you confirm the purchase or when an introductory trial ends. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current subscription period. Apple may charge your account for renewal within 24 hours before that period ends. You can manage or cancel your subscription in your Apple Account subscription settings and restore eligible purchases from Wake. Apple processes purchases and handles refunds under its applicable rules.

Ownership and feedback

Wake, its software, designs, branding, and content are owned by The Wake Labs LLC or its licensors and are protected by applicable law. We grant you a personal, limited, revocable, non-exclusive, non-transferable license to use Wake for its intended purpose. If you provide feedback, you permit us to use it without restriction or compensation.

Service changes and termination

Wake is evolving and may be modified, suspended, or discontinued. We may restrict access when reasonably necessary to protect Wake, users, or others, or when these Terms are violated. You may stop using Wake at any time. Provisions that by their nature should survive termination will survive.

Disclaimers and limitation of liability

To the fullest extent permitted by law, Wake is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or accuracy.

To the fullest extent permitted by law, The Wake Labs LLC and its contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, opportunities, travel, employment, or business arising from Wake. Nothing in these Terms excludes liability that cannot legally be excluded.

Changes and contact

We may update these Terms. Continued use after updated Terms take effect means you accept them, except where law requires another form of consent. If a provision is unenforceable, the remaining provisions remain effective.
